Manure Brokers
SC Regulation 61-43 was updated in 2002 to include specific requirements for manure brokers. A manure broker is defined as a person who accepts or purchases animal manure from agricultural facilities and transfers this product to a third party for land application. The manure broker may either spread the manure themselves or simply transfer the manure to the third party for land application. In either case, the manure broker and the third party are bound by the same land application requirements as the owner of any agricultural facility which produces animal manure. Manure brokers must be permitted through DHEC before he/she can accept or land apply manure in South Carolina. Manure brokers are required to keep records on from whom they buy manure and to whom they sell manure using a Manure Balance Sheet (PDF-3KB). Additionally manure brokers must enter into a Manure Transfer Agreement (PDF-19KB) with everyone who receives manure from them.
Land Applicators
The land applicator accepts or purchases animal manure from agricultural facilities; however, the land applicator does not transfer the manure to a third party for land application. The land applicator utilizes the manure on farm land that he/she actually farms without the involvement of a third party. The land applicator can accept or purchase manure from any agricultural facility. However, if the land applicator routinely receives 12 tons or more of manure from the same producer, the land applicator must be listed in the producer's animal facility management plan. Similar to the manure broker, the land applicator and the owner of the facility producing the manure must have a contract or agreement for the transfer of the manure. The land applicator is bound by the same land application requirements as the manure broker or the owner of any agricultural facility which produces animal manure.
