Licensing Info

Applicants for a tattoo facility must submit a completed application prior to initial licensing and all applicable licensing, inspection and certification fees. Applicants must also provide DHEC with a written statement verifying that the applicant has advertised his or her intent to apply for a tattoo facility license in the legal section of the local newspaper nearest to the location of the proposed facility at least once a week for three consecutive weeks. Facilities that perform tattooing prior to the effective date of licensure are in violation.

Training Requirements

Tattoo artists must be at least 21 years old. Annually, tattoo artists must successfully complete an approved course in blood-borne pathogens and tattoo/body piercing infection control and possess a certificate of successful completion. Technicians must also have a current American Red Cross First Aid Certification and a current CPR Certification obtained either from the American Red Cross, the American Heart Association or the National Safety Council. Review DHEC's approved health training programs.

1000-Foot Buffer Rule

A license will not be granted to a facility, nor can a facility conduct tattooing procedures within 1,000 feet of a church, school, or playground.

Zoning Requirements

Prior to performing tattooing procedures, a tattoo facility must provide DHEC a certified copy of an ordinance passed by the local governing body where the business is will be located which authorizes the tattooing of persons within its jurisdiction. Applicants must submit a certified copy of the applicable zoning ordinance from the appropriate governing authority, along with a signed statement from that entity's representative attesting to its validity.

Requirements for Out of State Practitioners

To work as a tattoo artist in South Carolina, an out of state individual must have a current and valid tattoo license or permit from another state that has requirements that meet the minimum requirements of South Carolina's regulation (i.e., age and training or 1,000 or more hours experience during the last 3 years performing tattooing procedures in a licensed or permitted tattoo facility) as confirmed in writing by the license from that state.

Regardless of who will be engaged in tattooing procedures in this state, for whatever length of time, he or she must be in compliance with the training, experience and age regulatory requirements set out in South Carolina's regulations.

Anyone who performs tattoo procedures at a facility is considered a staff member of the tattoo facility and is subject to the same regulatory requirements (e.g., training, experience and age) as any other tattoo facility staff member. The tattoo facility under which the 'guest' is performing tattoo procedures is responsible for the conduct of the individual with regard to compliance.
